Libertyville police responded to a domestic disturbance call about 6 a.m. Saturday on the 900 block of Cali Court. Spencer Foutes, 23, was shot after he pointed a gun at the police officers who were on the scene and also inside the townhouse in the well-kept Riva Ridge neighborhood. Police had arrived to find in bed with a handgun. They backed out of the room and Foutes came out of the bedroom and raised his gun at backup officers that were just arriving when he was shot by Libertyville police officer Alex Cardona, an eight year veteran who is expected to return to police work soon.
The man was pronounced dead at Condell Memorial Hospital just before 7 a.m. Foutes had a blood-alcohol content of .25 percent when he was tested after his death.
Vernon Hills police arrested had Foutes about 1:30 a.m. Saturday and charged him with driving under the influence of alcohol and resisting arrest. He was shot at his townhouse after he was released on bond. His mother Marilyn Foutes called police about 6:00 a.m. to report that his son was out control. The call taker at 9-1-1 dispatch was informed that no weapons were involved. In addition to the handgun that Foutes was holding, police removed shotguns, a crossbow and knives and swords from the residence after the shooting
The Lake County Major Crimes Task Force is investigating the shooting death by a police officer. Police officer Alex Cardona is on routine administrative leave for an officer-involved shooting.
The townhome overlooks MacArthur Woods Forest Preserve with multi-million dollar homes east of the forest preserve in Mettawa. The neighborhood is also located just east of Milwaukee Avenue (Route 21) and the Red Top Plaza shopping center.
