Personal injury law firm Corboy & Demetrio announced August 5, 2024 that the law firm has obtained a settlement of $2.3 million for the family of a 57-year-old intellectually disabled female resident of the Riverside Foundation in Lincolnshire, Illinois, who choked on an uncut meatball on November 3, 2018. Despite being prescribed a mechanical soft diet and requiring supervision during meals, the woman was given a whole meatball by nursing home staff, was not adequately monitored and later died.
Corboy & Demetrio Partners Michael D. Ditore and Thomas Demetrio represented the woman’s estate, and his settlement set a record for nursing home wrongful death cases in Lake County.
The lawsuit named as defendants …
The Riverside Foundation, a nursing home and intermediate care facility for adults with moderate-to-severe developmental disabilities;
Lincolnshire-Riverwoods Fire Protection District, which provided emergency services; and
each of the paramedics, individually, who arrived on the scene to treat the resident.
According to the complaint, Defendant Riverside Foundation neglected to adhere to the dietary restrictions, ensure adequate supervision, implement necessary measures to prevent choking incidents, and adequately train their personnel to perform life-saving interventions.
Riverside contacted emergency services and the Lincolnshire-Riverwoods Fire Protection District paramedics arrived on the scene but failed to save the woman’s life.
According to the complaint, Defendant Lincolnshire-Riverwoods Fire Protection District and its paramedics failed to promptly address her obstructed airway, failed to properly ventilate and oxygenate her, failed to properly monitor her, and failed to attempt a surgical airway, all of which resulted in her cardiac arrest and death.

In the settlement, Defendant Riverside Foundation paid $2,000,000 and Lincolnshire-Riverwoods Fire Protection District paid $300,000.
The settlement was obtained on Feb. 27, 2024.
