A male driver from McHenry was found guilty on Wednesday November 6, 2019 for a March 31, 2019 fatal crash when he was accused of failing to obey a stop sign and striking a 71 year-old pedestrian at the McHenry Home Depot parking lot.
Christian Zientko, age 20, was ordered to pay $1,026 in fines connected to a traffic citation he received after the fatal pedestrian crash. Zientko on Wednesday agreed with the facts of the March 31, 2019 crash that killed William Dammeyer of Johnsburg. McHenry County Judge Jennifer Johnson found Zientko guilty of the traffic ticket he received for failing to obey a stop sign when he struck Dammeyer in a crosswalk.
Convictions of vehicular manslaughter in most jurisdictions require that the prosecution prove, beyond a reasonable doubt …
– that the driver operated a motor vehicle in a reckless or grossly (severely) negligent manner, and
– the driver’s conduct caused a fatality.
Cases considered to involve less than grossly negligent or reckless conduct may not result in a vehicular manslaughter charge.
