An Arlington Heights man was convicted Wednesday February 21, 2019 for an incident that occurred in west suburban Batavia on July 13, 2017. Timothy M. Monty, age 45, was accused of bringing a loaded gun to the residence, where the person of a former relationship was located.
According to a news release from the Kane County state’s attorney’s office, Timothy M. Monty, of an apartment high-rise in the block of 3400 Stonegate Drive in Arlington Heights (near Euclid Avenue and Rohlwing Road), arrived at the Batavia residence about 5:00 p.m. July 13, 2017.
Monty tried to enter the residence in Batavia, where the precise location was not released, through the garage. When Monty couldn’t gain entry, he began shouting and banging on the front door.
A person inside the residence inadvertently opened the door — apparently unaware of Monty’s actions outside.
The victim, who had called 911 soon after Monty had arrived at the residence, told him not to enter the residence. Monty ignored the plea and entered the residence anyway, while yelling at the two people in the residence.
The Kane County State’s Attorney’s release said that Monty became aggressive while yelling, and at one point Monty’s face was touching the victim’s face. Eventually, after multiple requests, Monty left. Police arrived a short time later.
On Wednesday February 21, 2019 was found guilty of criminal trespass to residence and domestic battery, the release said.
Because of the conviction, Timothy M. Monty is ineligible to hold a FOID card, and is ineligible to hold a Concealed Carry License. He faces a sentence of probation or a range of one to three years in prison, according to the Kane County State’s Attorney’s Office. Timothy M. Monty’s sentencing hearing is scheduled for Thursday, April 18, 2019 at 1:30 p.m.
