A Manhattan jury awarded $2.33 million to hockey fan Dustin Dibble, who lost his right leg after falling drunk onto the N train tracks along the path of an oncoming subway train. dibble had been drinking and watching a hockey game at a bar.
The jury ruled that the driver of the subway train was still responsible for stopping for objects that might be pedestrians on the track. Dibble’s blood-alcohol level at the time of the accident was .18, which is more than double the legal limit. He was ruled 35% responsible for the accident, so his malpractice award was reduced by 35 percent.
